1. Who you are buying from

This store is operated by Elmsett. You can reach us at hello@elmsett.com and we aim to reply within 2 business days. "We" and "us" refer to Elmsett; "you" means the person placing the order.

2. These terms

By placing an order you accept these terms, together with our Returns and Refunds, Shipping and Privacy policies. Nothing in these terms excludes, restricts or modifies the consumer guarantees you have under the Australian Consumer Law. We may update these terms; the version on this page when you order is the one that applies to that order.

3. Prices and GST

Prices are in Australian dollars and include GST. A tax invoice is issued with your order confirmation. We may change prices at any time, but never after you have placed an order.

4. Your order

Your order is an offer to buy. A contract is formed when we confirm dispatch, not when you receive the order confirmation email. We may decline or cancel an order before dispatch – for example if the rug has sold out, if there has been an obvious pricing or description error, or if we cannot deliver to the address safely. If we cancel, we refund you in full, and we tell you why.

Our rugs come in limited runs. When a run sells out we generally do not repeat it.

5. Colour and texture

Every screen renders colour differently, and our photographs are taken under lighting that will not match your room. A wool-blend pile also changes appearance with the direction of the light and the lie of the pile, and dye lots vary slightly between production runs. Our photographs, swatch images and colour descriptions are indicative rather than an exact match, and a difference between your screen and the rug on your floor is not a fault. Each rug has its full set of photographs on its own page, including close-ups of the pile and the rug in a room – that is the most faithful record of it we can give you.

A new rug sheds loose fibres for the first 2–6 weeks, and arrives with creases from being rolled. Both are normal and settle.

6. Size

Rugs are described by their nominal finished size – for example 200 x 300 cm. Our rugs are finished to a tolerance of ±2% on each dimension, which is normal for the craft. On a 200 x 300 cm rug that is up to 4 cm across the width and 6 cm along the length. Measure your space against the nominal size and allow for that tolerance.

7. Delivery

Delivery times, areas and costs are set out in our Shipping policy. Risk in the rug passes to you on delivery. Title passes when we have received payment in full.

8. Returns

Your return and refund rights, including your rights when something is wrong with a rug, are set out in our Returns and Refunds policy.

9. Using your rug

Rugs are made for indoor domestic use. We recommend an underlay on hard floors: it stops the rug moving, protects the backing and the floor, and makes the rug feel better underfoot. Follow the care instructions supplied with the rug; damage caused by unsuitable cleaning products or professional processes we have not recommended is not covered by a consumer guarantee.

10. Our content

The text, photographs, style names and designs on this site belong to Elmsett or our licensors. You may not copy or use them commercially without our written permission.

11. Liability

To the extent permitted by law, and other than the rights you have under the Australian Consumer Law, we are not liable for indirect or consequential loss arising out of your purchase. Where we are permitted to limit a remedy, our liability is limited to replacing the rug or refunding what you paid for it.

12. Governing law

These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
